Question 1

Do I still need a $200 tax stamp?

Accepted Answer

Congress reduced the federal making and transfer tax to $0 for covered suppressors. Under current ATF enforcement guidance, prior NFA approval and registration are no longer federally enforced for covered transfers. Forms remain available voluntarily, and registration may still be needed under state or local law. Your dealer confirms the process for your jurisdiction.

Question 2

Can LayerX ship my suppressor directly to my house?

Accepted Answer

LayerX ships suppressors to your eligible FFL/SOT dealer or Capitol Armory, not directly to a customer’s home. Your receiving partner confirms the transfer requirements and available services for your jurisdiction.

Question 3

Do I need a background check?

Accepted Answer

Suppressors remain firearms under the Gun Control Act. Applicable dealer-to-consumer transfers continue to require Form 4473 and applicable background checks unless a valid legal exemption applies. Dealer records, federal firearm restrictions, and state and local law still apply.

Question 4

Does my dealer need an SOT?

Accepted Answer

Businesses engaged in manufacturing, importing or dealing in suppressors remain subject to applicable Special Occupational Tax requirements. LayerX’s existing FFL/SOT dealer onboarding and verification requirements remain intact.

Question 5

Could these rules change again?

Accepted Answer

ATF may change this policy. Its FAQ warns that there is no guaranteed grandfathering or later registration opportunity for unregistered NFA items if enforcement resumes. Discuss registration options and applicable state law with your dealer before choosing a pathway.
